OVERVIEW
This website is operated by Salt Lake Mahjong Club. Throughout the site, the terms “we”, “us” and “our” refer to Salt Lake Mahjong Club. We offer this website—along with information, tools, classes, events, and services (collectively, the “Service”)—to you, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.
By visiting our site and/or purchasing or registering for anything from us, you engage in our “Service” and agree to be bound by these Terms of Service (“Terms”), including any additional terms and policies referenced herein and/or available by hyperlink. These Terms apply to all users of the site, including without limitation browsers, vendors, customers, and contributors of content.
Please read these Terms carefully before accessing or using our website. If you do not agree to all the terms and conditions, you may not access the website or use any Service. If these Terms are considered an offer, acceptance is expressly limited to these Terms.
Any new features or tools added to the current website, classes, events, or offerings will also be subject to these Terms. You can review the most current version of the Terms at any time on this page. We reserve the right to update, change, or replace any part of these Terms by posting updates to our website. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
Our website is hosted on Squarespace, Inc., which provides the online platform that allows us to offer our classes, events, products, and related Services to you.
SECTION 1 – WEBSITE, CLASSES & EVENTS TERMS
By agreeing to these Terms, you represent that you are at least 18 years old or the age of majority in your jurisdiction, or that you are the age of majority and have given us consent to allow any of your minor dependents to use this site and/or attend events as permitted.
You may not use our Service for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
You must not transmit any worms, viruses, or code of a destructive nature.
A breach or violation of any of the Terms will result in immediate termination of your access to the Service.
SECTION 2 – GENERAL CONDITIONS
We reserve the right to refuse Service to anyone for any reason at any time.
You understand that your content (not including credit card information) may be transferred unencrypted and involve (a) transmissions over various networks and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without our express written permission.
Headings are for convenience only and do not limit these Terms.
SECTION 3 – ACCURACY, COMPLETENESS & TIMELINESS OF INFORMATION
We are not responsible if information on this site is not accurate, complete, or current. Material is provided for general information only and should not be relied upon as the sole basis for decisions without consulting more accurate or timely sources. Any reliance is at your own risk.
We may modify the contents of this site at any time but have no obligation to update information. You agree it is your responsibility to monitor changes.
SECTION 4 – MODIFICATIONS TO THE SERVICE AND PRICES
Prices for our classes, events, and products are subject to change without notice.
We reserve the right to modify or discontinue the Service (or any part or content thereof) at any time without notice.
We shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance.
SECTION 5 – PRODUCTS, CLASSES & EVENTS (IF APPLICABLE)
Certain offerings may be available exclusively online and may have limited quantities or limited seating; availability is not guaranteed. Returns, credits, or exchanges are governed by our Refund Policy (link to be added).
We attempt to display colors and images as accurately as possible but do not guarantee your device’s display accuracy.
We reserve the right, but are not obligated, to limit sales or registrations to any person, geographic region, or jurisdiction; to limit quantities; and to discontinue any offering at any time.
We do not warrant that the quality of any offerings, information, or other material will meet your expectations or that errors in the Service will be corrected.
SECTION 6 – ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any order or registration. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. In the event we make a change or cancel, we may attempt to notify you via the email and/or billing address/phone number provided. We may limit or prohibit orders that, in our judgment, appear to be placed by dealers, resellers, or distributors.
You agree to provide current, complete, and accurate purchase and account information and to promptly update such information so we can complete your transactions and contact you as needed.
For more details, please review our Refund Policy (link to be added).
SECTION 7 – OPTIONAL TOOLS
We may provide access to third-party tools “as is” and “as available” without warranties or endorsements. We have no liability arising from your use of optional third-party tools.
Any use by you of optional tools is entirely at your own risk and discretion.
We may also offer new features or resources in the future; such features will be subject to these Terms.
SECTION 8 – THIRD-PARTY LINKS
Certain content, products, and Services available via our Service may include materials from third parties.
Third-party links may direct you to websites not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability for third-party materials or websites.
Review third-party policies before engaging in any transaction. Complaints or questions regarding third-party products should be directed to the third party.
SECTION 9 – USER COMMENTS, FEEDBACK & OTHER SUBMISSIONS
If you send us submissions (e.g., ideas, suggestions, proposals), you agree we may edit, copy, publish, distribute, translate, and use them in any medium at any time without restriction and without obligation to (1) maintain confidentiality, (2) pay compensation, or (3) respond.
We may monitor, edit, or remove content we determine to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene, or otherwise objectionable, or that violates any party’s intellectual property or these Terms.
You agree your submissions will not violate any rights of third parties or contain unlawful, abusive, or obscene material, malware, or misleading information. You are solely responsible for your submissions and their accuracy.
SECTION 10 – PERSONAL INFORMATION
Your submission of personal information through the website is governed by our Privacy Policy (link to be added).
SECTION 11 – ERRORS, INACCURACIES & OMISSIONS
Occasionally there may be information on the site or in the Service that contains typographical errors, inaccuracies, or omissions that may relate to descriptions, pricing, promotions, offers, scheduling, and availability. We reserve the right to correct errors or omissions and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order or registration).
We undertake no obligation to update or clarify information except as required by law. No specified update or refresh date should be taken to indicate all information has been modified or updated.
SECTION 12 – PROHIBITED USES
In addition to other prohibitions set forth in these Terms, you are prohibited from using the site or its content:
(a) for any unlawful purpose; (b) to solicit others to perform unlawful acts; (c) to violate any regulations, rules, laws, or ordinances; (d) to infringe upon our or others’ intellectual property rights; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate; (f) to submit false or misleading information; (g) to upload or transmit malware; (h) to collect or track personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent security features. We may terminate your use of the Service for violating any prohibited use.
SECTION 13 – IN-PERSON CLASSES & EVENTS: ASSUMPTION OF RISK; RELEASE; LIMITED LIABILITY
13.1 Assumption of Risk. By registering for or attending any in-person class, event, or gathering hosted or organized by Salt Lake Mahjong Club (each, an “Event”), you acknowledge that participation is voluntary and may involve inherent risks, including but not limited to minor injuries, slips or falls, food or beverage reactions, and exposure to communicable illnesses. You understand and accept these risks and agree to participate at your own risk.
13.2 Health & Conduct. You are responsible for assessing your own health and ability to participate. You agree to follow all Event rules and any instructions provided by our staff or venue personnel. If you have any medical conditions, allergies, or concerns, you are responsible for taking appropriate precautions.
13.3 Release. To the maximum extent permitted by applicable law, you hereby release and discharge Salt Lake Mahjong Club and its owners, officers, employees, contractors, agents, volunteers, and venue partners from any and all claims, demands, causes of action, damages, losses, costs, or liabilities arising out of or related to your attendance at or participation in an Event, except to the extent caused by our gross negligence or willful misconduct.
13.4 Limitation of Liability (Events). To the maximum extent permitted by law, our aggregate liability for claims arising from or related to any Event shall not exceed the total amount you paid to attend that Event, if any.
13.5 Photography/Video. Events may be photographed or recorded. By attending, you grant us the right to use your likeness for promotional purposes in any media, without further notice or compensation, unless you notify us in writing prior to the Event.
13.6 Venue Policies. You agree to comply with all venue rules and policies. We reserve the right to refuse or revoke admission for any reason consistent with applicable law.
SECTION 14 – DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
We do not guarantee, represent, or warrant that your use of the Service will be uninterrupted, timely, secure, or error-free.
We do not warrant that results obtained from the Service will be accurate or reliable.
You agree that we may remove the Service for indefinite periods or cancel the Service at any time without notice.
You expressly agree that your use of, or inability to use, the Service is at your sole risk. The Service and all products and Services delivered to you are (except as expressly stated by us) provided “as is” and “as available,” without any warranties or conditions of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement.
In no case shall Salt Lake Mahjong Club, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise, arising from your use of the Service or any products or Events, or for any other claim related in any way to your use of the Service, including any errors or omissions in any content, even if advised of the possibility. Because some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, in such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
SECTION 15 – INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Salt Lake Mahjong Club and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms or the documents they incorporate by reference, or your violation of any law or the rights of a third party.
SECTION 16 – SEVERABILITY
If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be deemed severed, without affecting the validity and enforceability of any remaining provisions.
SECTION 17 – TERMINATION
Obligations and liabilities incurred prior to termination shall survive termination for all purposes.
These Terms are effective unless and until terminated by either you or us. You may terminate at any time by notifying us that you no longer wish to use the Service or when you cease using the site.
If in our sole judgment you fail, or we suspect you have failed, to comply with any term or provision, we may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or we may deny you access to the Service (or any part thereof).
SECTION 18 – ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
These Terms and any policies or operating rules posted by us on this site or in respect to the Service constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications, and proposals.
Any ambiguities shall not be construed against the drafting party.
SECTION 19 – GOVERNING LAW
These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Utah, United States.
SECTION 20 – CHANGES TO TERMS OF SERVICE
You can review the most current version of the Terms at any time at this page.
We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of changes constitutes acceptance of those changes.
